CPSC eFiling Takes Effect with Relaxed Enforcement – TPL Reminds Exporters: Compliance Obligations Remain

On July 8, 2026, the U.S. Consumer Product Safety Commission (CPSC) officially implemented its mandatory PGA Message Set (eFiling) regulation. All CPSC-regulated consumer products imported into the U.S. must now electronically file compliance certificate data through the PGA Message Set into CBP's ACE system at the time of entry.Prior to the effective date, the industry widely feared that "missing filings would mean immediate detention" and mass port congestion. On the very day the rule took effect, U.S. Customs and Border Protection (CBP) issued CSMS #69177694, clarifying that a phased flexible enforcement approach would be adopted during the current stage.
Key Adjustments Include:
· Differentiated Filing Validation Rules: Unlike other Partner Government Agencies (PGA) that require integrated ABI software to prevent filings with missing data for HTS codes with "MUST" flags, CPSC has chosen not to implement such a requirement. Customs will not automatically reject entries due to missing CPSC PGA Message Set data.
· Pre-arrival Interception Removed: Goods may be cleared and released first, with post-clearance verification conducted through manual review, random inspections, targeted examinations, and after-entry audits. Businesses with incomplete documentation can supplement materials as required.
· Lighten the load on customs broker systems: CPSC doesn’t require customs software to have mandatory declaration blocking features. Software providers also don’t need to ask filers for PGA information sets for any HTS codes for CPSC.
· Flexible Enforcement During Transition: During the buffer period, mere omission of filing information generally will not result in immediate penalties. However, products that fail to meet safety standards or involve falsified compliance documents will still face strict enforcement actions.
Critical Reminder:
Flexibility does not mean exemption from compliance obligations. Under CBP's existing regulatory framework, even if goods are released, Customs will still conduct verification through multiple risk control channels. If filing anomalies or missing compliance certificates are discovered, Customs retains the authority to issue detention orders, require businesses to submit complete documentation within a specified period, and initiate administrative actions in serious cases. The CPSC eFiling obligation remains mandatory - only the enforcement approach has been temporarily relaxed.
TPL Recommendations :
· Complete eFiling electronic filings in advance to reduce inspection rates from the source.
· Retain complete product test reports, compliance certificates (CPC/GCC), and production traceability labels.
· Ensure accurate HTS classification and obtain valid compliance certificates from suppliers early.
· Keep CPC certificate, IOR importer, and eFiling information consistent across all three parties.
